Is this considered fraud?

Hey, just wondering but if I sell a World of Warcraft account and take it back is it againts the law? I know its againts Blizzards ToU but like will I get in trouble with the law if I steal it back? Cause it has my name on the account and you can never change it. Please answer specificly. Thanks
